1.\u00a0Acceptance<\/h4>

By creating an account, checking \u201cI Accept\u201d, or using the Platform, the user agrees to these Terms and Conditions (\u201cT&C\u201d) and the applicable Privacy Policy.<\/p>

If the user does not agree, they must not register or use the Platform.<\/p>

The user declares having legal capacity to contract. If acting on behalf of a company, the user declares being duly authorized.<\/p><\/div><\/div>

2.\u00a0Definitions<\/h4>

\u201cPlatform\u201d: the mobile application, web panel, services, databases, APIs, and related reports.<\/p>

\u201cUser\u201d: any person who registers or uses the Platform (architect\/supervisor, collaborator, client\/investor, supplier, as applicable).<\/p>

\u201cAdvertiser\u201d: a company that purchases advertising space within the Platform and\/or reports.<\/p>

\u201cContact Data\u201d: first and last name, company\/studio, email address, phone number, and equivalent contact details.<\/p>

\u201cContent\u201d: information uploaded by the user (photos, videos, audio, transcriptions, texts, documents, drawings, checklists, statuses, comments, and reports).<\/p><\/div><\/div>

3.\u00a0Purpose and scope<\/h4>

The Platform enables documenting, registering, organizing, and reporting progress, observations, issues, and quality controls related to works, installations, and\/or services.<\/p>

The Platform may operate online\/offline and synchronize data when connectivity is available.<\/p>

The Platform is a technological tool and does not replace technical supervision, professional inspection, or legal\/contractual obligations.<\/p><\/div><\/div>

4.\u00a0Registration and account<\/h4>

The user must provide accurate and up-to-date information.<\/p>

The user is responsible for their account, credentials, and all activity carried out through it.<\/p>

The Platform may implement verification and security mechanisms.<\/p>

The Platform may suspend or limit accounts in case of misuse or breach of these T&C.<\/p><\/div><\/div>

5.\u00a0Versions, advertising, and commercial use of data<\/h4>

The Platform may offer free, basic, premium, or other versions.<\/p>

Free\/basic version: the user accepts in-app advertising and\/or ads in PDF reports.<\/p>

Paid version: generally ad-free unless expressly stated otherwise.<\/p>

Sharing of Contact Data (free version): the user expressly agrees that Contact Data may be shared with verified advertisers for commercial purposes.<\/p>

Sharing of Contact Data (paid version): the user also expressly agrees to such sharing.<\/p>

Minimum shared data may include name, company, email, phone, and other contact details provided by the user.<\/p>

Purpose: monetization through advertising and commercial connection between users and advertisers.<\/p>

The Platform is not responsible for advertisers\u2019 use of shared data.<\/p>

Opt-out: if no opt-out mechanism exists, data sharing is a condition of use.<\/p>

PDF reports may include advertising logos without contact details, unless otherwise configured in the future.<\/p><\/div><\/div>

6.\u00a0User content and license<\/h4>

The user retains rights over uploaded Content and grants the Platform a non-exclusive, worldwide, sublicensable license to operate the service.<\/p>

The user declares having sufficient rights to upload the Content.<\/p>

The Platform may apply technical transformations to optimize storage and delivery.<\/p>

The user is solely responsible for Content accuracy and usage.<\/p><\/div><\/div>

7.\u00a0Administrator access and visibility<\/h4>

The system administrator may access information necessary for operation, support, and security.<\/p>

The administrator may view projects, metrics, and Content when required.<\/p>

The administrator may manage advertising and data sharing under these T&C.<\/p>

The administrator assumes no responsibility for technical or professional decisions made by users.<\/p><\/div><\/div>

8.\u00a0Offline operation, synchronization, and data loss<\/h4>

Offline capture and later synchronization may be enabled.<\/p>

Synchronization depends on connectivity and device configuration.<\/p>

The Platform does not guarantee the absence of data loss.<\/p><\/div><\/div>

9.\u00a0Limitation of liability<\/h4>

The Platform is provided \u201cas is\u201d and \u201cas available\u201d.<\/p>

It does not guarantee work results or third-party performance.<\/p>

To the maximum extent permitted by law, no liability for indirect damages or loss of profits.<\/p>

The user shall indemnify the company against third-party claims.<\/p><\/div><\/div>

10.\u00a0Intellectual property<\/h4>

The Platform is the exclusive property of:<\/p>

No ownership rights are transferred to the user.<\/p>

Reverse engineering, copying, resale, or unauthorized use is prohibited.<\/p>

11.\u00a0Modifications and termination<\/h4>

The Platform may update features, plans, and these T&C.<\/p>

Access may be suspended or terminated in case of breach or legal requirements.<\/p>

Account cancellation may result in loss of access to Content.<\/p>

Data deletion is subject to legal and retention obligations.<\/p><\/div><\/div>

12.\u00a0Governing law and jurisdiction<\/h4>

These T&C are governed by the laws of Hong Kong.<\/p>

Any dispute shall be submitted to arbitration in Hong Kong.<\/p>

Arbitration shall be conducted in English.<\/p>

Courts of Hong Kong shall have jurisdiction for enforcement or urgent matters.<\/p><\/div><\/div>

13.\u00a0Contact<\/h4>

Users may contact the Platform through official channels within the app or website.<\/p><\/div><\/div>

14.\u00a0Express consent<\/h4>

I declare that I have read and accepted the Terms and Conditions. I understand and agree that my contact data may be shared with verified advertisers for commercial purposes, both in the free and paid versions.<\/p><\/div><\/div><\/div>
